Q&A: Do I Need A Personal Injury Lawyer?

Dear Siniard, Timberlake, & League,

Last week, I was involved in a car crash.  I was hit from behind and the impact caused a chain reaction.  In total there were four cars involved.  My vehicle was totaled as a result and I suffered severe burns and bruising from the airbag deployment.  As expected, I’ve also been really sore.  I did make a visit to the emergency room and am now seeing my family doctor.  Although I think I’ll be fine eventually, my family keeps urging me to consult a lawyer before I speak with the at fault driver’s insurance company.  I’m not sure if I need a lawyer and I’m concerned about how much it will cost if I do. 

How do I decide if I should see a lawyer regarding the wreck?

Dear Christy,

We are sorry to hear about your crash and the pain you’re experiencing.  But, you’re asking the right question.  It’s one that many people have but may be too intimidated or concerned about the cost to seek an answer.  So let’s address your concerns.

Do you need a personal injury lawyer?

Whether you need a lawyer or not can generally depend on the severity of the crash and the nature of the injuries incurred as a result.  Of course, more serious injuries, which may require a hospital stay or an extended recovery time, could benefit from attorney representation.

Even though not every situation calls for hiring an attorney, when you’re in the midst of trying to recover, physically or financially, from an accident, it can be tough to make a decision.  That’s why we encourage you to call us so that we can help you make the most informed decision possible.  We don’t want worries about need or cost to prevent you from seeking the assistance and representation you need.

It’s also important to note that you don’t have to speak with anyone from the insurance company if you don’t feel comfortable doing so.  Understand that the insurance adjuster that is attempting to contact you is well versed in the law that controls your claim.  They may use this knowledge to minimize or invalidate your claim.  Feel free to contact a lawyer and discuss your rights first. A knowledgeable attorney can explain the applicable law and know the pitfalls that your claim may face.  If you do hire an attorney, he or she will handle those insurance company calls on your behalf and you will not have to talk with the adjuster.

What is the cost to consult with a lawyer?

There is no cost to see us for an initial consultation.  We want to make sure that you have all of the information you need to make a decision that’s most beneficial for you and your family.  For that reason, we are glad to answer questions and address your concerns during a free consultation.  Consultations may be conducted by phone or here in our office.  If you are unable to come to us, we may be able to make arrangements to come see you.  And if you do decide to hire us, we are only paid when and if we collect on your behalf.
